1. Introduction
a) These Terms and Conditions set out the terms on which products are supplied to you as a buyer on www.elafiya.com.
b) Please read these terms carefully. By placing an order on the Site, you agree to be bound by these Terms and Conditions immediately upon submission.

2. Order Acceptance
a) Order Acceptance: Our acceptance of your order will occur when we notify you of our acceptance in writing (via email or SMS). If we are unable to accept your order, we will inform you in writing or by phone, and you will not be charged for the product.
b) Payment: By placing an order, you authorize us or our third-party payment processor to process your credit/debit card details for the total amount of your order. We accept the following payment methods:

Credit/Debit card.
Cash on delivery (up to 300 USD/1000 SAR).
c) Order Cancellation: You may cancel your order immediately before shipment for any reason.
d) Our Cancellation: We may cancel your order if:
You fail to make payment when due.
You do not, within a reasonable time, provide us with necessary information to fulfill the order.
You do not, within a reasonable time, allow us to deliver the products or collect them from us.

3. Delivery of Your Order
a) Delivery Costs: Delivery costs will be displayed to you on the Site, but customs charges are not included and each customer is responsible for paying these fees according to their country's customs policies.
b) Delivery Time: Delivery will take between 3 to 5 business days from the date of shipment, but delays may occur due to customs.
c) Delivery Delays:

If the delivery of the product is delayed due to circumstances beyond our control, we will contact you as soon as possible and take steps to minimize the impact of the delay.
If no one is available at the delivery address and the product cannot be posted through the letterbox, we will notify you about how to rearrange the delivery or collect the product.
If you do not collect the product or rearrange delivery after a failed attempt, we will contact you for further instructions. If, despite our reasonable efforts, we are unable to contact you or arrange delivery, we will cancel your order.
d) Title to Products: Ownership of the product will pass to you once the product is delivered to the delivery address and you have paid for the product.

4. Product Descriptions
elafiya.com strives to provide accurate descriptions of the products on this site. However, we do not guarantee that these descriptions are accurate or error-free.

5. Pricing Information
elafiya.com seeks to provide accurate pricing information for the products and services available on this site. However, we cannot guarantee the accuracy of the pricing. elafiya.com reserves the right to cancel or refuse orders with incorrect pricing, whether due to an error or other issue.

6. Returns & Exchanges
There is no right of withdrawal for food items or cosmetics & personal care products. However, as we care about customer satisfaction, we accept returns for orders that have not yet shipped or products that were damaged during shipping.
The right of withdrawal is not valid if you change your address while your order is in transit, or if the arrival of your order is missed for special days or events.
If the packaging of your product is damaged during shipping, or if the packaging is so damaged that the product's quality is affected, you may request a return.
For the item you wish to return, the full price will be refunded or the order will be reshipped free of charge, depending on your choice.

7. Warranties, Representations & Undertakings
a) You warrant, represent, and undertake that:

You will fully comply with all applicable laws, statutes, and regulations, including, but not limited to, privacy laws and content regulations.
You have full power and authority to enter into these Terms and Conditions and to make payment in accordance with them.
If you purchase a product on behalf of a business entity, you represent that you are authorized to act on behalf of the business and bind the business to these Terms and Conditions.
b) Subject to clause 5.1, our services are provided on an “as is” basis, without any representations, warranties, or conditions of any kind. We disclaim all warranties, conditions, and representations, whether express, implied, or collateral, including but not limited to all conditions, representations, or warranties of merchantability, fitness for a particular purpose, non-infringement, compatibility, or that our services are secure, error-free, will operate without interruption, or will be provided in a timely or proper manner.

8. Liability
Nothing in these Terms and Conditions shall limit or exclude a party’s liability for:
a) Fraud, including fraudulent misrepresentation, perpetrated by that party.
b) Death or personal injury caused by the negligence of that party.
c) Any other liability that cannot be limited or excluded under applicable law.

elafiya.com reserves the right to update, change, or modify these Terms and Conditions at any time. Any changes will be posted on this page, and they will become effective immediately upon posting. By continuing to use the Site, you accept the updated Terms and Conditions.

10. Governing Law
These Terms and Conditions are governed by the laws of the Republic of Turkey. Any disputes arising under these Terms will be resolved in the competent courts of Istanbul.
